Acceptable Use, Content and Safety Policy

This policy also appears as sections 4 and 5 of our Terms of Service and forms part of them. It is repeated here on its own because it is the part of our terms customers most need to read before uploading a photograph.
The basics
We print the photograph you send us onto a fridge magnet. We don't know where your photo came from or who is in it — only you do. So before you upload anything, please make sure of two things:
- You have the right to use the image.
- Everyone recognisable in it has agreed to be on a printed product.
1. Your promises about the image
Every time you upload an image, you are promising us that:
(a) You own it, or you have permission. You took the photo, or bought it with reproduction rights, or the copyright owner said yes.
The one that catches people out: copyright in a photograph usually belongs to the photographer, not to the person in it and not to whoever paid for the shoot. School portraits, wedding photos, newborn shoots, studio family portraits and headshots are normally owned by the studio. Printing one without a release is copyright infringement even though it's a picture of your own family. If you're not sure, ask the photographer — most will say yes for personal use.
(b) It isn't someone else's protected work — not a photo, artwork, illustration, cartoon character, logo, brand or design belonging to someone else, unless you have permission. That includes images found in a search engine, saved from a website or social media, or generated by an AI tool from someone else's protected work.
(c) Everyone identifiable has consented. If someone can be recognised, you have their agreement. If they're a child, you are their parent or legal guardian, or you have the guardian's permission.
(d) The content is lawful and doesn't fall into the list below.
If you can't honestly say all four, please don't upload it.
2. What we won't print
We will refuse any image that:
- infringes someone's intellectual property — copyrighted photos, art, characters, logos or brands you have no right to use
- uses a person's face or likeness without consent, including public figures and celebrities
- is sexually explicit or pornographic
- sexualises, exploits or endangers a minor in any way — an absolute line, no exceptions, no context makes it acceptable
- promotes hatred, harassment or violence against people on the basis of race, ethnicity, national origin, religion, disability, sex, gender identity, sexual orientation, age or any other protected characteristic
- depicts or glorifies extreme violence, gore, terrorism or mass atrocity
- promotes self-harm, suicide or eating disorders
- is defamatory, or is designed to harass, threaten, bully, stalk, humiliate or intimidate a specific person
- exposes someone's private information without consent — addresses, phone numbers, ID documents, medical records
- advertises illegal goods or services, or is otherwise unlawful
- is made to deceive — counterfeit branding, forged identification
3. How we apply this
We check every photo for print quality before we print it — size, sharpness and brightness — and we'll email you if yours doesn't look like it will come out well. We check carefully, but we can't promise to catch every problem.
That quality check is not a rights check. We have no way of knowing who took a photo, who owns it, or who is in it, and we don't try to find out. Us printing your image never means we've confirmed you had the right to use it, or that it doesn't breach the rules above. That responsibility stays with you, and if we miss something it doesn't mean we approved it or that you are off the hook.
We may refuse or cancel any order on these grounds, before or after payment, at our discretion. If we refuse your order, you get a full refund of everything you paid. We'll tell you it was refused; we may not explain our reasoning in detail.
Repeat breaches mean we may decline to serve you in future.
Unlawful content. We may report it to law enforcement and preserve the file and your order details. Where content appears to be child sexual abuse material, we are legally required to report it to the National Center for Missing and Exploited Children (NCMEC) and to cooperate with investigations.
Our decision on whether we will print something is final for our purposes. You're free to take your order elsewhere.
4. If someone uploads your image
If you believe an image we've printed infringes your copyright, uses your likeness without permission, or otherwise breaches this policy, email hello@magnetosf.com with "Content complaint" in the subject line.
Tell us:
- what the content is, and where you saw it
- what right you hold and how we can verify it
- your contact details
We take this seriously. We operate a notice-and-takedown approach consistent with the DMCA (17 U.S.C. section 512): on a valid notice we stop using the content, and we pass valid notices on to the customer concerned.
5. If you break these rules
Under section 4.3 of our Terms of Service, you agree to indemnify us — meaning if someone sues us or makes a claim against us because of an image you uploaded, you cover our losses and reasonable legal costs. That is the trade: we print anything you legitimately have the right to print, and the responsibility for having that right stays with you.
6. Product safety warning
WARNING: CHOKING AND INGESTION HAZARD.
Keep away from children under 3. Magnets can cause serious internal injury if swallowed. Seek immediate medical attention if swallowed.
This is not a toy. If more than one magnet is swallowed, or a magnet is swallowed along with any other metal object, they can attract each other through the wall of the intestine and cause blockage, perforation, blood poisoning or death. Symptoms can resemble an ordinary stomach upset. If you suspect a magnet has been swallowed, go to an emergency department immediately and tell them a magnet may have been ingested — do not wait to see whether it passes.
Keep magnets and any broken pieces away from young children and pets. Check magnets occasionally for cracks or a loose backing and dispose of damaged ones safely.
